Any order for a product appearing in the online shop of the website requires prior consultation of these general conditions and their acceptance.

1. Acceptance and application of the conditions

The customer acknowledges having read, at the time of placing the order, the conditions of sale set out here and declares to accept them without reservation. These general terms and conditions of sale govern the contractual relationship between Comesa-sarl and its customer, both parties accepting them without reservation. These general terms and conditions of sale shall prevail over all other conditions contained in any other document, unless otherwise agreed in advance, expressly and in writing. Acceptance of the buyer

These general terms and conditions of sale as well as the prices are expressly agreed and accepted by the buyer, who declares and acknowledges that he is fully aware of them, and therefore waives the right to rely on any contradictory document and, in particular, his own general terms and conditions of purchase, the act of purchase involving acceptance of these general terms and conditions of sale.

2. Prices

Comesa-sarl reserves the right to modify its prices at any time, but the products will be invoiced on the basis of the prices in force at the time the orders are placed (subject to availability). The products remain the property of Comesa-sarl until full payment of the price.

The prices of our products are indicated in Euros. The prices indicated on the product sheets are expressed inclusive of all taxes and including VAT for France and EEC countries but do not include transport costs. When ordering online, the total price indicated in the order confirmation includes the price of the products, as well as the shipping costs.

* The Discount Codes may not be traded in any way (exchange, transfer, transmission, etc.) for a monetary value outside the website.

* Sending an order to an address other than that of account creation will not be possible.

3. Ordering

5. Shipping & Returns

The products will be sent to the delivery address indicated by the buyer during the ordering process. The contribution to the shipping costs is inclusive of VAT. Any delays do not entitle the buyer to claim damages.

The delivery times indicated cannot be guaranteed, they are present for information purposes only, not contractual.

In the event of apparent defects, the buyer has the right of return under the conditions provided for in this document. The customer then only pays for one delivery. If the customer wants 2 places of delivery, he places 2 orders, with the related delivery costs.

To reduce transport costs as much as possible, all products of small or medium size are shipped by a Colissimo Suivi postal service. In addition to being economical, this service delivers within 48 hours throughout France and offers you the possibility of recovering the products ordered at your post office close to the delivery address in case of absence of the initial delivery place when the factor is presented. In practical terms, if you are absent on the day of delivery, your postman will leave you a notice in your mailbox, which will allow you to pick up your package at your post office during business hours, within 10 days. In the event of a lost package, no compensation can be granted until the result of an investigation by the carrier.

After a period of 30 days, from the date of shipment of your order, no claims will be accepted.

Damaged package

SERENITY INSURANCE: No claim will be accepted without the purchase of Serenity insurance in the event of damage (breakage, leakage, loss...) or theft of packages. Photos of the package and damaged products will be requested. It is necessary that the parcel number appears on these pictures showing the poor condition of the Colissimo (photograph of the contents and packaging).

If your parcel is delivered directly to your mailbox or by your postman and is unfortunately damaged: you must go to your post office to ask them for a damage report without opening it. If it is not requested on the same day as your delivery, the post office will refuse to send it to you and therefore our services will not be able to access any claim for compensation.

Returns under the NPAI reason

Colissimo Suivi is a very reliable service. However, as in any shipment, there may be a delay in delivery or the product may get lost. In the event of a delay in delivery compared to the date we indicated in the shipping email, we ask you to inform us of this delay by sending us an email. We will then contact the Post Office to start an investigation. A Post investigation can take up to 21 days from the date of commencement of the investigation. If during this period, the product is found, it will be immediately redirected to your home (in most cases). If, on the other hand, the product is not found at the end of the 21-day investigation period, Swiss Post considers the package lost. Only then can we send you a replacement product, at our expense. If the ordered product(s) were no longer available at that time, we would refund you the amount of the products affected by the carrier's loss. If the product(s) were still available, but had changed the selling price on the site, we would apply the new selling prices, either by refunding you by cheque for the difference, or by requesting an additional cheque for this price difference. We decline any responsibility for any extension of delivery times due to the carrier, particularly in the event of loss of products or strike.

6. Payment of payment

Payment for purchases in France is made by credit card (credit card, Visa, Eurocard/Mastercard).

Any delay in payment, as from the contractual due date, will result in the application of Article L441-6 of the French Commercial Code. A fixed indemnity of 40 € will become automatically payable as well as the additional costs of recovery without any prior formality. In addition, interest will be charged on a penalty equal to the ECB rate plus 10 points.

7. Secure payment

The order validated by the customer will only be considered effective when the bank payment centres concerned have given their agreement. It is advisable to return the package by registered mail, in the event that it is lost during the postal shipment,

After a period of 30 days, from the date of shipment of your order, no claims will be accepted.

Conditions of Reimbursement:

In the event of non-receipt of the order within the aforementioned delivery times, for any reason other than force majeure or the Customer's fault,

9. Applicable law of disputes

>Complaints or disputes will always be received with attentive benevolence, good faith being always presumed in the person who takes the trouble to explain his situations. In the event of a dispute, the customer will first contact the company to obtain an amicable solution. This contract is subject to French law. The language of this contract is the French language. In case of dispute, the court of Angers is the only competent court. Comesa-sarl cannot be held liable for any damage of any kind, whether material or immaterial or physical, that may result from improper operation or use of the products marketed. The liability of Comesa-sarl shall, in any event, be limited to the amount of the order and may not be held liable for simple errors or omissions that may have remained despite all the precautions taken in the presentation of the products. In any case, Comesa-sarl cannot be held liable for non-compliance with the regulatory and legislative provisions in force in the country of receipt, its liability is systematically limited to the value of the product in question, its value at the date of sale and this without any possibility of recourse against the brand or the company producing the product.

Any attempt to cheat in order to acquire loyalty points through the back door, abusive multiplication of accounts under names with a different spelling, will be the subject of a complaint before the Public Prosecutor and will be charged a fee of 150€ to open a dispute file. This article shall not prevent the transfer or transfer of activities to a third party.
